Privacy policy
This is an English translation of our Dutch privacy statement. In the event of any discrepancy, the Dutch version prevails.
Introduction
De creatieve directie B.V. (hereinafter: “we”) processes personal data of its clients, prospects and other contacts. We do this to help our contacts as well as possible and to achieve our objectives. In this privacy statement, we explain why and how we process your personal data.
We do not have a Data Protection Officer (DPO), but we are happy to help you with your questions. You can contact us via info@dcd.nl or +31 (0)20 7 220 770.
Who are we?
We are de creatieve directie: a direct marketing advertising agency. This privacy statement applies to all our processing activities – including when we process personal data together with other parties.
What personal data do we process?
We process the following personal data:
First and last name, address, place of residence, telephone number, gender, email address, job title, payment details, contact history, IP address, social ID, cookie ID (you can read more about cookies in our cookie statement) and browsing behaviour. We do not process personal data of our clients’ contacts, i.e. third parties.
Why do we process this personal data?
We process personal data for the following purposes:
- Legal obligations
A small part of our processing is required by law. This mainly concerns personal data needed to meet our tax obligations. But we may also, for example, process personal data in the event of emergencies.
- Relationship management and services
In our client and relationship database, we keep track of which organisations are clients or relations of de creatieve directie, together with the relevant contact persons. We keep various personal data of contact persons in order to deliver our services as well as possible. For example, we keep contact details, as described above, so that we can reach you.
You can reach us through various channels: telephone, post, email, LinkedIn and Facebook, for example. To make this possible, we also process personal data.
- Newsletters and mailings
If you no longer wish to receive newsletters, you can unsubscribe via any email.
- Privacy Waarborg
Contact details are processed in order to conduct, send and assess the Privacy Waarborg audits.
- Acquisition (marketing)
We move with the industry, which is why we recruit new prospects and sometimes new colleagues. We acquire new clients based on the interests of our target audience. And to tailor our content to this as closely as possible, we process the contact details and areas of interest of everyone involved.
We also use ‘custom audiences’ via social media platforms. We do this via Facebook and LinkedIn targeting. (Personalised) advertisements may be shown on these platforms. We do not pass on any personal data to third parties for this purpose, unless you have given your unambiguous consent.
If you do not want advertisements to be shown to you via these platforms, you can let us know using the contact details above. You can also opt out with these platforms directly. You can read how to do this on the following pages:
Please note: you may still see advertisements from de creatieve directie afterwards if you fall within a general target audience at which we aim our advertisement.
- Improving the services of de creatieve directie
Rights of data subjects
Under the GDPR, everyone has a number of rights. We do our utmost to comply with these as well as possible. Do you have any tips or comments? Please let us know! To exercise your rights, you can contact us via info@dcd.nl or +31 (0)20 7 220 770.
- Information and access: You can of course see which personal data we process about you. We are also happy to tell you more about how and why we process that data.
- Rectification: Do you think we have incorrect data about you? Let us know and we will correct it.
- Erasure: You can have the personal data we hold about you deleted. We may still need to process that data for other purposes (such as administration or deduplication).
- Restriction: If you believe we are processing your personal data unlawfully or incorrectly, you can also have that processing restricted.
- Objection: You can object to the processing of your personal data. Does it concern marketing? Then we will stop that processing as soon as possible.
- Data portability: This is a new right under the GDPR to have your personal data transferred. If you would like to make use of this, please contact us.
In addition, you can also:
- Withdraw consent: for example for receiving email. If you want to withdraw your consent for another type of processing, you can contact us.
- File a complaint with the Dutch Data Protection Authority (AP): Do you think we are not acting in accordance with privacy legislation? Then of course we would like to hear about it.
Retention periods
We do not keep personal data longer than necessary.
Legal bases for processing
As explained above, we process some data to comply with a legal obligation, some to perform an agreement (contract) and most for the legitimate interest of de creatieve directie: pursuing our objectives. Would you like to know more about the assessment we make regarding legitimate interest? You know where to find us!
Third-party recipients
We engage service providers to deliver our services. These are not ‘third-party recipients’ but processors. For example, we work with an ESP and a cloud environment, and we use Google Analytics. These parties process personal data in accordance with the instructions of de creatieve directie.
Sometimes we are legally obliged to provide personal data to third parties, such as the Dutch Tax Administration. Otherwise, we will only provide data to third parties if we have received your consent to do so.
Links
The website of de creatieve directie contains a number of links to websites of other organisations. De creatieve directie is not responsible for the way in which those parties process personal data. For that, please read the privacy statement of the organisation concerned.
